Chapter IV - Section 26

MHS    Mobile Home Subdivision District

A.   PURPOSE

    This section is established for the purpose of providing minimum standards and provisions for the creation of a mobile home subdivision. This type of subdivision, which shall be utilized exclusively by mobile homes, is similar to conventional single-family, medium-density residential developments where land is subdivided into individual lots for individual ownership.

B.    PERMITTED PRINCIPAL USES

D.   ACCESSORY BUILDINGS AND USES (See also Section 35.1)

      1.   Convenience Store

      3.   Home Occupation as provided in §35.6
      4.   Management Headquarters (Permanent Occupancy)
      5.   Outdoor Recreational Facility such as a Swimming Pool, Tennis Court, Putting Green

E.   DEVELOPMENT REQUIREMENTS

    1.   Those uses containing an asterisk (*), refer to the corresponding number in Section 35.5 for additional development requirements.

    2.   Those uses identified with a pound sign (#) are secondary uses to be conducted in conjunction with Principal (Primary) Uses.

    3.   There shall be no more than one (1) mobile home unit on any lot.

    4.   Mobile Home Subdivision

      a.   Minimum area: Twenty (20) acres

      b.   Minimum frontage on a dedicated public street:   Two hundred (200) feet

      c.   Shall be served by a public (central) water and sewer system

    5.   Access, Internal Street System and Pedestrian Walkways

      a.   Access to the Mobile Home Subdivision shall be provided in accordance with the El Paso County Subdivision Regulations.

      b.   The internal street system shall be devised for the most advantageous development of the Mobile Home Subdivision. The street system should be designed to serve the local needs of the neighborhood and to provide direct access to the abutting properties. All traffic should have an origin and destination within the neighborhood.

        1)   Public right-of-way shall be constructed in accordance with the El Paso County Subdivision Regulations.

        2)   Private Internal Roadways

          a)   The roadways shall be hard surfaced with either asphalt or concrete with a minimum width of forty-two (42) feet.

          b)   The roadways shall be privately owned, constructed and maintained.

          c)   The roadways shall be designed for safe and convenient access to all spaces and to facilities for common use and provide adequate space for utilities.

      c.   Pedestrian walkways shall be provided adjacent to the private internal roadways in a width of not less than three (3) feet excluding curb and gutter. Walkways shall also be provided to facilities for common use. All walkways shall be hard-surfaced with either asphalt or concrete.

    6.   Fencing and Landscaping

    The boundary of the mobile home subdivision shall be fenced, minimum height of six (6) feet. Where the boundaries abut a public park or dedicated open space, the screening buffer may be in the form of hedges, evergreens and shrubbery. The screening buffers, open spaces, and setback areas shall be privately owned, constructed and maintained.

    7.   Open Space

    A minimum of eight (8) percent of the total subdivision shall be set aside for recreational purposes. Adequate public access (vehicular and/or pedestrian) shall be provided to all recreational facilities. Such open space shall be privately owned, constructed and maintained.

    8.   Common Area

    A minimum of one hundred (100) square feet per mobile home lot, hard surfaced, enclosed with a security fence, shall be set aside for outside storage. The storage area shall only be used by resi-dents of the mobile home subdivision.

    9.   Mobile Home Subdivision Lot

      a.   Minimum lot area

        1)   Six thousand (6,000) square feet, required for mobile homes measuring fourteen (14) feet or greater in width.

        2)   Five thousand (5,000) square feet, required for mobile homes measuring less than fourteen (14) feet in width.

      b.   Setback Requirements

        1)   Front yard: Twenty (20) feet 2) Side yards: Ten (10) feet 3) Rear yard: Ten (10) feet

      c.   Minimum setback when adjacent to a public street: Twenty-five (25) feet.

      d.   There shall be no minimum side or rear yard setbacks if provisions are made by indicating setback lines on the final plat so as to ensure that no mobile home shall be closer than twenty (20) feet to any other mobile home in any direction.

      e.   Minimum of two (2) off-street parking spaces shall be provided per lot equaling three hundred sixty (360) square feet.

      f.   All mobile homes are required to be skirted.

      g.   Lots on the periphery of the subdivision must front toward the interior of the subdivision. No mobile home lot in the Mobile Home Subdivision shall front on a street where the opposite side of the street is in a different zone.

    10.   Special Design Provisions for a Mobile Home Subdivision

    This section is designed to encourage imagination in design toward the objective of a better living environment.

      a.   Lot sizes may be reduced from the minimum square footage provided that:

        1)   Forty (40) percent of the amount of the reduction be converted to open space.

        2)   Ten (10) percent of the amount of the reduction be devoted to common storage areas for recreational vehicles.

        3)   Fifty (50) percent of the amount of the reduction may be devoted to new lots.

      b.   If lot sizes are reduced in accordance with a. above, then:

        1)   There will be no minimum lot depth.

        2)   The minimum setbacks shall be:

          a)   Front yard: Ten (10) feet

          b)   Side yard: Ten (10) feet

          c)   Rear yard: Ten (10) feet

          d)   When the Mobile Home Subdivision property line is adjacent to a public street: the setbacks shall be ten (10) feet.

          e)   There shall be no minimum side or rear yard setbacks if provisions are made by indicating setback lines on the final plat so as to ensure that no mobile home shall be closer than twenty (20) feet to any other mobile home in any direction.

    11.   Setbacks for accessory buildings or structures for a mobile home lot:

      Front - Not allowed Side - Five (5) feet from side lot line Rear - Five (5) feet from side lot line

      In all cases accessory buildings or structures shall have a minimum separation from a mobile home or other accessory buildings or structures as required by the El Paso County Regional Building Code.

    12.   Setbacks for accessory buildings or structures for the mobile home park:

      Twenty-five (25) feet from any exterior boundary line of the park.

      Twenty (20) feet from any interior roadway.

      Twenty (20) feet from any mobile home lot.

    13.   Height limit: Unless otherwise specified all buildings and structures shall not exceed a height of thirty (30) feet.

F.   PLOT PLAN

    A plot plan conforming to the requirements of Section 37 shall be approved by the Planning Director prior to the Planning Division's authorization for the issuance of a building permit or occupancy of the park.

G.   MAINTENANCE PLAN

    In cases in which maintenance of roads, walkways, landscaping, common areas, open space, or other facilities identified in section D. are proposed to be maintained by homeowners associations, or other nongovernmental bodies, the applicant shall submit a maintenance plan conforming to the requirements of Section 38. A maintenance statement addressing owner-ship and maintenance shall be submitted with the rezoning request. The maintenance plan shall be submitted concurrently with the Final Plat and recorded prior to or in conjunction with the Final Plat.

H.   GENERAL DEVELOPMENT REGULATIONS

    1.   Off-street parking - Refer to Section 35.3
    2.   Advertising devices - Refer to Section 35.4
    3.   Landscaping requirements - Refer to Section 35.12

I.   PLATTING REQUIREMENT

    Occupancy of a mobile home park shall not be allowed on any portion of property which is currently zoned MHS (Mobile Home Subdivision) District until and unless the property is platted in accordance with the El Paso County Land Development Code, as amended, unless otherwise exempted by statute.
