to be posted ten days before any disposal proceedings are initiated.
2.
DISPOSAL OF PROPERTY
After
the period of posting and public notice of disposal proceedings,
the following steps shall be utilized in the disposal of public
property. Each step shall be investigated and answered before
proceeding to the next step.
a.
Public Agencies
Contact
and offer to transfer property by deed to a local government
agency serving the subject area that is currently providing
park and recreation services or willing to provide park and
recreation services; and that would agree to accept the surplus
property as a park and to operate, maintain, and develop the
property as a public park.
b.
Public Groups
Contact
and offer to transfer, by deed, to a local, legally constituted
Homeowners' Association organized under the laws of Colorado.
Such organization would agree to accept the surplus property
as a park and to operate, maintain and develop the property
as a park area, open for use by all property owners, within
the subdivision that contains the park.
c.
Developer
Contact
and offer to return the property to the original subdivision
developer/donator in exchange for the full amount of fees in
lieu of land that would have been originally collected at the
time the property was donated. Any funds collected would be
reserved for acquisition and/or development of regional parks
within the County.
d.
Public Sale
Advertise
and receive sealed bids for the sale of this property to potential
purchaser. Bids to be opened at a specified time and place.
Funds collected from this sale of surplus property to be reserved
for acquisition and/or development of regional parks within
the County.
OR
Advertise
and sell subject property at public auction.
In
either case, the amount of "fees in lieu" that would
have originally been collected for park purposes, plus any costs
related to the sale of the property would constitute the lowest
price for which the property would be sold. Established minimum
or beginning sale prices would be identified for each parcel
to be sold under either method.

be limited to:

(3) Director of County Parks Department
(4) Representative from the County Health Department
(5) Representatives from industry, including, but
not limited to:
(a)
Homebuilder's Association
(b) Board of Realtors
(c) A registered professional engineer, licensed
in Colorado

Representative from the public, or public interest groups.
b.
Members shall be appointed by the Board of County Commissioners
with the recommendation of the Development Services Director.
