Approximately 100 acres will be leased from the State Land Board. The actual plant will consume approximately 35 acres of the southeast corner of the site. An application for use by special review is running concurrently with this rezone application. The property is located approximately four miles east of the Ray Nixon Power Plant, three miles east of I-25, four miles southeast from the City of Fountain, and directly west of the proposed Meridian Road. Request by the Development Services Department to revise the Land Development Code (Adopted October 12, 2006) chapters 4.3.1 CAD-O Commercial Airport Overlay District, Chapter 8.5.2 (B and C) Park and Open Space Standards and Dedications, Chapter 8.5.3 (B and C) School Land Standards and Dedications, and to add a new definition "Airport Notice and Disclosure Statement", and to make any conforming amendments to the Land Development Code. The revisions modify the zoning overlay applicable to land which will be identified on the Commercial Airport District Overlay map and the standards applicable to dedication of Park and School sites.

Presently, the only land area included the GA-O Overlay
is located at Meadowlake Airport.

GENERAL CODE CLEANUP ITEMS

Request by the Development Services Department to revise the Land Development Code (Adopted October 12, 2006) by modifying the definitions of Animal Day Care Facility, Development Services Director, Development Services Department, and Structure; amend Section 5.5.2 Dimensional Variances and Appeals to the Board of Adjustment to reinstate consideration of unique and equitable circumstances; revise Table 5.2 to include a personal use greenhouse as an allowed accessory building and use; and revise Section 5.4.3 (D) 8 Deck Setbacks to reflect that the deck height measurement is to the floor elevation of the deck, rather than the railing height. Approval would include authorization to make any conforming amendments to the Land Development Code.
