Chapter IV - Obsolete Zones
(No Property will be Rezoned to the R-4. C-1. C-2 or M Districts)

C-1   Commercial District

A.   PURPOSE

    This district is established for the purpose of providing for commercial activities.

B.   PERMITTED PRINCIPAL USES

      1.   Billiard Parlor
      2.   Bowling Alley
      3.   Bus or Train Station
      4.   Child Care Center *10
      5.   Club
      6.   Financial Institutions
      7.   Funeral Parlor
      8.   Hotels and Motel
      9.   Kennel *2
    10.   Laboratory
    11.   Office Park
    12.   Park
    13.   Parking Lot
    14.   Public Park & Open Space
    15.   Repair Shop
    16.   Restaurant
    17.   Stores, other than those in C-2 Commercial District
    18.   Studio
    19.   Tower, Private (See §35.11) #
    20.   Theater

D.   DEVELOPMENT REQUIREMENTS*

    *1.   For those uses containing a footnote, please refer to Section 35.5 for additional development requirements.

    #2.   Those uses identified with a pound sign (#) are secondary uses to be conducted in conjunction with Principal (Primary) Uses.

    3.   Minimum lot area:   None.

    4.   Maximum structural height:   Thirty (30) feet.

    5.   Minimum width:   None.

    6.   Setback requirements:

      a.   Front yard:   Fifteen (15) feet.
      b.   Side yards:   See requirements for walls. Where adjacent to a residential district, the standards of that district shall apply.
      c.   Rear yard:   Fifteen (15) feet except where adjacent to a residential district, the standards of the more restrictive district shall apply.
      d.   Gasoline Pumps:   Fifteen (15) feet from any street.
      e.   Stands:   Thirty-five (35) feet.

    7.   Walls:

      a.   If there is no side yard the side wall of the building shall be constructed of four (4) hour fire resistant material. If there is a side yard, it shall be at least three (3) feet. b. If the side wall material is less than four (4) hour fire resistant, the side yard shall not be less than five (5) feet where this district adjoins any other district other than a residential district.

H.   MAINTENANCE PLAN

    A maintenance plan conforming to the requirements of Section 38 shall be approved by the Director of the Development Services Department prior to the issuance of any building permit, if applicable.

J.   STANDARDS FOR REVIEW

    The Development Services Director shall utilize the standards set forth in the El Paso County Land Development Guidelines and in Section 49.1 "Development Regulations" of the Subdivision Regulations in reviewing and approving density, use, and design features in the plot plan and letter of intent.

K.   PLATTING

    No building permits shall be applied for or granted on any portion of property which is currently zoned C-1 (Commercial) District until and unless the property is platted in accordance with the El Paso County Land Development Code, as amended, unless otherwise exempted by Statute.

    If a property, at the time of its creation, was established in accordance with all applicable El Paso County Subdivision Regulations, platting of said property is not required for the authorization by the Development Services Department for the issuance of a building permit. It shall be the responsibility of the person(s) seeking such authorization to submit the necessary documentation to the Development Services Department to substantiate the legal creation of the property.

L.   No land in the unincorporated portion of El Paso County shall be zoned or rezoned to C-1 (Commercial) District on or subsequent to May 1, 1991.

All land in the unincorporated portion of El Paso County zoned C-1 (Commercial) District on or before May 1, 1991, shall remain so zoned and subject to all the provisions of said zone district until such time as said land is either rezoned to another valid zone district or annexed to a municipality.
