49.1
Development Regulations
A.
PRELIMINARY PLAN AND FINAL PLAT
When
submitting a preliminary plan and final plat at the same time, the
same requirements are necessary as filing each separately.
B.
MINIMUM LOT SIZES FOR WATER AND SEWER
l.
The use of individual water and sewer systems shall
be permitted only on lots of five (5) acres or more and only in
cases in which the reports required in Sections 51.2 and 51.3
are approved by The County Health Department and the State Engineer,
except as pro-vided in subsection B.3 of this section.

On lots of less than five (5) acres, the subdivider shall install
a public water system and a public sewer system, except as modified
in subsection B.3 of this section. Such public systems shall be
installed in conformance with the requirements of the State Health
Department, County Health Department, State Engineer, and The
Area-wide Waste Water Quality Plan.

A subdivider may utilize an individual water system,
or an individual sewer system, or both on lots of between two
and one-half (2½) and five (5) acres if a report or reports
conforming to the requirements of Section 51.7 A, B, C, are submitted
along with the sketch plan (or if no sketch plan is submitted,
the preliminary plan), approved, and found to be consistent with
the per-formance standards outlined in Section 49.2 M.
C.
In the event that the land to be partitioned, platted
and sold, is burdened by a County Road on section line along any
of its sides, then and in that event only, the lot width at the
building setback line shall be a minimum of one hundred sixty-five
(165) feet and the mini-mum acreage requirement shall be four and
three-fourths (4.75) acres.*
D.
No public improvements shall be constructed prior to
approval by the County Engineer and conformance to the requirements
of Section 49 and 51.1 D.
E.
Drainage structures and channels outside the road right-of-way
shall be maintained by the landowner, unless otherwise indicated.
F.
CONFORMITY WITH EL PASO COUNTY LAND USE PLAN
The
Development Services Department, the Planning Commission and the
Board of County Commissioners shall study the plat of the subdivision
in connection with the Land Use Plan for El Paso County.
G.
REQUIREMENTS
Each
subdivision and plat thereof shall be in conformity with the standards
as set forth or referred to herein to ensure that subdivision development
takes into account the basic design principles necessary for a safe,
serviceable, attractive and healthy living environment.
H.
BUILDABLE LOTS
All
subdivisions shall result in the creation of lots which are developable
and which have adequate building sites.
I.
ACCESS TO PUBLIC STREETS
All
lots or parcels created by a subdivision of land shall have frontage
upon a dedicated maintained public street
