Section 4
Submittal Requirements
A.
ZONING AND REZONING PETITIONS, USE SUBJECT TO SPECIAL REVIEW, VARIANCE
OF USE, NONCONFORMING USE
1.
Letter of Intent (10 copies): The petitioner shall submit a letter
of intent conforming to the requirements for letters of intent
(see Section 36).
2.
Legal Description (1 copy): Typed separate document.
3.
Map (10 copies): Map shall be at a scale suitable to describe
the information required and shall include:
a.
Boundary description of the subject property which shall illustrate
the legal description.
b.
Existing land uses and zoning on the property and within five
hundred (500) feet of the boundary.
c.
Adjoining property ownership.
d.
Existing private roads.
e.
Existing structures.
f.
Existing easements.
g.
Name and addresses of the petitioner, owners of all interests
(including mineral interests), in the property, and preparer.
4.
Ownership
a.
Petition (1 copy): Signed by the property owner(s), or
provide evidence (notarized statement) that property owner(s)
has given authority to the appli-cant to submit the petition.
b.
Proof of Ownership: The applicant shall submit an ownership
and en-cumbrance statement for the subject property issued by
a title company and dated within thirty (30) days of the submittal
day.
The
petition also includes the notification of adjoining property
owners. Notification may be accomplished by the adjoining property
owner(s)' signing the petition, notification through the mail
or a combination of the two. If notification through the mail
is used, it must be accomplished by Certified Mail with proper
documentation indicating that notification has taken place submitted
as part of the petition.
5.
Filing Fee, Refer to Section 58.
6.
Petitions for Zoning or Rezoning to R-4 (Planned Development)
and PUD (Planned Unit Development) Districts
In
addition to the submittal requirements outlined in Paragraph A
of this section, the following information shall be submitted:
a.
Development Plan (10 copies): Conforming to the requirements
of Section 37.5.
b.
A separate map (10 copies), drawn to scale containing
the following information:
1)
Adjoining land use and zoning within five hundred (500)
feet of the exterior boundary of the subject property.
2)
All roads (public or private) including functional classification,
type of surface, and width within five hundred (500) feet
of the subject property.
3) Existing topography based on the following criteria:
(a)
Size of Lots Contour
Interval
One
(1) acre or less two
(2) feet
Larger
than one (1) acre five
(5) feet
(b)
Accuracy shall be no less than 1/2 contour interval.
(c)
Contour interval to twenty (20) feet may be acceptable
based on the following criteria:
(d)
Contours shall be extended no less than one hundred
(100) feet onto adjacent property and shall show significant
adjacent topography
c.
Phasing Program (10 copies): If development is to occur in stages
then a detailed phasing program shall be provided in accordance
with Paragraph M of Section 17.5. The program may be in narrative
form or incorporated into the Development Plan. The program
shall include a breakdown of all land use types and both on-site
and off-site transportation and drainage improvements by phase.
d.
Maintenance statement (5 copies) addressing ownership and maintenance
of proposed roads, common areas, open space or other facilities
which will not be maintained by public entities.
7.
Petitions for Variance of Use, Use Subject to Special
Review, and Noncon-forming Use
In
addition to the submittal requirements outlined in Paragraph A
of this section, the following information shall be submitted:

PETITIONS FOR VARIANCE OF PHYSICAL REQUIREMENTS (BOARD
OF ADJUSTMENT)
1.
Letter of Intent (10 copies): Conforming to the requirements of
Section 36
2.
Site Map (10 copies): The map shall be drawn at a scale suitable
to describe the information required and shall include:
a .
Boundary dimensions and size
b. Adjoining property owners, uses and zoning
c. All existing and proposed buildings and structures, easements,
setbacks and roads, fully dimensioned
3.
Legal Description (1 copy): Typed separate document
4.
Petition (1 copy): Signed by the property owner or provide evidence
(notarized statement) that property owner(s) has given authority
to applicant to submit the application.
The
petition also includes the notification of adjoining property
owners. Notification may be accomplished by the adjoining property
owner(s)' signing the petition, notification through the mail
or a combination of the two. If notification through the mail
is used, it must be accomplished by Certified Mail with proper
documentation indicating that notification has taken place submitted
as part of the petition.
5.

C.
ADMINISTRATIVE PLOT PLAN REVIEW
1.
Letter of Intent (10 copies): Conforming to the requirements of
Section 36
2.
Plot Plan (10 copies): Conforming to the requirements of
Section 37
3.
Landscaping Plan (10 copies): Conforming to the requirements of
Section 35.12
4.
Detail Plans (10 copies): Signs, condominium units,
mobile home pads, outside lighting, etc., if applicable
5.
Elevation Plans (10 copies): If applicable
6.
Filing Fee, Refer to Section 58.
D.
SITE SPECIFIC DEVELOPMENT PLAN (VESTED PROPERTY RIGHTS)
1.
If vesting of a Site-Specific Development Plan is being requested
concurrent with review of an application for a plat, a PUD (Planned
Unit Development) Development Plan, or a Generalized (Master)
PUD Development Plan, the ordinary submittal requirements will
be sufficient with the following additions:
a.
Separate or modified Letter of Intent including specific description
of vesting being requested and justification.
b.
Approximate filing fee - see Chapter 58.
2.
Consideration of a vesting application for a plot plan shall not
be allowed concurrent with its administrative review.
3.
The following submittal requirements apply to applications for
vesting of PUD Development Plans, plats or plot plans, which have
previously been approved by the Board of County Commissioners
or Development Services Director:
a.
Letter of Intent - five (5) copies - to include applicant contact
information, specific nature or request, justification, and
signature or authority of owner.
b.
Legal description of property proposed for vesting.
c.
Ownership and encumbrance statement issued by a title company
within thirty (30) days of submittal date.
d.
Filing fee; refer to separate Board of County Commissioners'
Resolution.
e.
Five (5) copies of any polot plans, plats or PUD Development
Plans proposed for vesting.
f.
Two (2) copies of any approved Landscaping Plans, Detail Plans
or Elevation Plans which pertain to the property, if applicable.
