Chapter IV - Section 15

R-3   Residential District

A.   PURPOSE

    This district is established for the purpose of providing for multifamily dwellings and nursing homes.

B.   PERMITTED PRINCIPAL USES

    1.   Adult Care Home *10
    2.   Child Care Facility *10
    3.   Dwelling, Multifamily  (3 or more units)
    4.   Group Home *10
    5.   Public Park & Open Space
    6.   Religious Institution *4
    7.   Rooming & Boarding House
    8.   Tower, Private (See §35.11) #

C.   USES SUBJECT TO SPECIAL REVIEW (SPECIAL USES)

      1.    Adult Care Home *10
      2.   Child Care Facility *10
      3.   College & University
      4.   Educational Institution
      5.   Emergency Facility
      6.   Fraternity & Sorority House
      7.   Group Home *10
      8.   Hospital
      9.   Hospital, Convalescent
    10.   Library
    11.   Mineral Resource Extraction   (See §§35.8 and 35.13)
    12.   Tower, Private (See §35.11) #

D.   ACCESSORY BUILDINGS & USES

    1.   Refer to Section 35.1

    2.   Home Occupations as provided in Section 35.6.

    3.   Development requirements for detached garages or carports

      a.   Front yard:   Twenty-five (25) feet
      b.   Side and rear yards:   Five (5) feet provided that sufficient vehicular access is provided from an alley

E.   DEVELOPMENT REQUIREMENTS

    1.   Those uses containing an asterisk (*), refer to the corresponding number in Section 35.5 for additional development requirements.

    2.   Those uses identified with a pound sign (#) are secondary uses to be conducted in conjunction with Principal (Primary) Uses.

    3.   There shall only be one (1) Principal (Primary) Use conducted on a lot or parcel of land. Certain child care facilities, adult care homes, and group homes may be conducted in conjunction with a residential dwelling, religious institution, educational institution, college and university as appropriate in accordance with these Zoning Regulations.

    4.   Minimum lot area:

      a.   Dwelling, Multifamily: Five thousand (5,000) square feet for the first two (2) units with an additional one thousand (1,000) square feet for each additional unit to a maximum of thirty (30) units per net acre.

      b.   All other uses: Ten thousand (10,000) square feet.

    5.   Maximum percentage of structural coverage of lot: Sixty (60) percent.

    6.   Maximum structural height: Forty (40) feet.

    7.   Minimum width of lot at front building setback line: Seventy-five (75) feet.

    8.   Setback requirements:

      a.   Each lot is individually developed:

        1)   Front yard: Twenty-five (25) feet
        2)   Side yard: Fifteen (15) feet
        3)  Rear yard: Fifteen (15) feet

      b  . Townhome or condominium development: 1) Twenty-five (25) feet from the perimeter boundary of the development. 2) Zero (0) feet from any internal lot line within the development.

    9.   Minimum distance between buildings: Ten (10) feet.

F.   PLOT PLAN

    A plot plan conforming to the requirements of Section 37 shall be approved by the Development Services Director prior to the Development Services Department's authorization for the issuance of a building permit.

G.   MAINTENANCE PLAN

    In cases in which maintenance of roads, common areas, open space, or accessory buildings and other facilities are proposed to be maintained by homeowners associations, or other nongovernmental bodies, the applicant shall submit a maintenance plan conforming to the requirements of Section 38 prior to the Development Services Department's authorization for the issuance of a building permit, if applicable.

H.   GENERAL DEVELOPMENT REGULATIONS

    3.   Landscaping Requirements - Refer to Section 35.12

I.   PLATTING REQUIREMENT

    Any parcel of land which is to be used for condominiums, apartments, or any other multiple-dwelling units, which when previously subdivided or zoned, was not accompanied by a filing which complied with the requirements for preliminary plans and final plats, shall be required to comply with such requirements prior to issuance of a building permit. Any parcel of land for which R-3 zoning is requested, shall be required to comply with the requirements for preliminary plans and final plats prior to issuance of a building permit (four lots or less may follow the Minor Subdivision procedures).
