LAND DEVELOPMENT CODE

Chapter IV - Obsolete Zones
(No Property will be Rezoned to the R-4. C-1. C-2 or M Districts)

M   Industrial District

A.   PURPOSE

This district is established for the purpose of providing for general industrial and manufacturing activities.

B.   PERMITTED PRINCIPAL USES

    1.   All commercial, industrial and manufacturing uses except Special Uses, below.
    2.   Public Park & Open Space
    3.   Tower, Private (See §35.11) #

C.   USES REQUIRING SPECIAL APPROVAL (SPECIAL USES)

      1.   Adult Use *16
      2.   Acid Manufacture
      3.   Asphalt Plant
      4.   Batch Plant
      5.   Cement Manufacture
      6.   Child Care Center *10
      7.   Dwelling
      8.   Explosives Manufacture
      9.   Fertilizer Manufacture
    10.   Fuel Sales & Storage (Wholesale)
    11.   Glue Manufacture
    12.   Junkyard *13
    13.   Livestock Feed Yard
    14.   Livestock Sales Yard
    15.   Metal Processing Plant
    16.   Mineral Resource Extraction (See §§35.8 and 35.13)
    17.   Mineral Processing Plant
    18.   Petroleum Refining
    19.   Plaster of Paris Manufacture
    20.   Rendering Plant
    21.   Scrap Tire Only Disposal Faciltiy  (See Chapter VI)
    22.   Scrap Tire Recycling Facility   (See Chapter VI)
    23.   Slaughterhouse
    24.   Smelter

D.   DEVELOPMENT REQUIREMENTS*

    *1.   For those uses containing a footnote, please refer to Section 35.5 for additional development requirements.

    #2.   Those uses identified with a pound sign (#) are secondary uses to be conducted in conjunction with Principal (Primary) Uses.

    3.   Minimum lot area:   None.

    4.   Maximum height:   Fifty (50) feet.

    5.   Setback requirements:

      a. Front yard:    Structures or advertising devices shall be set back not less than fifteen (15) feet from any street or highway right-of-way line.

      b.   Side yard:    Structures or advertising devices shall not be located within fifteen (15) feet of the side lot line.

      c.   Rear yard:    None.

      d.   Stables & corrals:    Fifty (50) feet from all property lines.

    6.   All junkyards shall have the area used for said purposes completely surrounded by a solid incombustible fence, not less than six (6) feet in height with solid gates for entry. The material stored within the junkyard shall not be stacked higher than the fence height.

E.   ACCESSORY BUILDINGS AND USES

    1.   Please refer to Section 35.1.
    2.   Dwellings designed for the primary purpose of protection of industrial buildings and sites.

F.   MAINTENANCE PLAN

    A maintenance plan conforming to the requirements of Section 38 shall be approved by the Development Services Director prior to the issuance of any building permits, if applicable.

G.   GENERAL REGULATIONS

    Off-street Parking - Refer to Section 35.3
    Advertising Devices - Refer to Section 35.4
    Landscaping Requirements - Refer to Section 35.12
    Temporary Uses - Refer to Section 32

H.   PLATTING

    No building permits shall be applied for or granted on any portion of property which is currently zoned M (Industrial) District until and unless the property is platted in accordance with the El Paso County Land Development Code, as amended, unless otherwise exempted by Statute.

    If a property, at the time of its creation, was established in accordance with all applicable El Paso County subdivision regulations, platting of said property is not required for the authorization by the Development Services Department for the issuance of a building permit. It shall be the responsibility of the person(s) seeking such authorization to submit the necessary documentation to the Development Services Department to substantiate the legal creation of the property.

I.   DISCONTINUANCE OF ZONING OR REZONING

    1.   No land in the unincorporated portion of El Paso County shall be zoned or rezoned to M (Industrial) District on or subsequent to May 1, 1991.

    2.   All land in the unincorporated portion of El Paso County zoned M (Industrial) District on or before May 1, 1991, shall remain so zoned and subject to all the provisions of said zone district until such time as said land is either rezoned to another valid zone district or annexed to a municipality.
